Continuing Y2K litigation Issues

[T]he purposes of this Act are-(l) to establish uniform legal standards that give all businesses and users of technology products reasonable incentives to solve year 2000 computer date-change problems before they develop; (2) to encourage continued remediation and testing efforts to solve such problems by providers, suppliers, customers, and other contracting partners; (3) to encourage private and public parties alike to resolve disputes relating to year 2000 computer date-change problems by alter¬native dispute mechanisms in order to avoid costly and time-consuming litigation, to initiate those mech¬anisms as early as possible, and to encourage the prompt identification and correction of such problems; and (4) to lessen the burdens on interstate commerce by discouraging insubstantial lawsuits while preserving the ability of individuals and businesses that have suffered real injury to obtain complete relief.
To accomplish these basic goals the Act imposes various procedural and substantive limitations on Y2K litigation. The defendant may then elect to remediate the failure or submit the matter to some form of alternative dispute resolution, such as mediation or arbitration. Until the defendant is given the opportunity to cure or informally resolve the dispute. the Act empowers the court to stay the plaintiff’s case. The Act also imposes additional pleading requirements on prospective Y2K plaintiffs. A Y2K plaintiff must specifically plead the nature and amount of each element of damage, including a description of any material defects upon which the lawsuit is based.

LG Chocolate 3 To Hit The Streets

Any day the new LG Chocolate 3 Cell phone will be real eased to the public. This one is the third in the series for Venison. Unlike the first two phones, this one will not be a slider but a clamshell type phone. The VX8500 and VX8550 were the first two chocolate phones. The new LG Chocolate 3 is the model VX8560.
Those who love to use their phones to listen to music will really like this one because it is especially geared for mobile music. It will start off being available in Light Blue and Black. It has a whooping 1GB storage capacity for more music than ever before. It will also have internal memory plus microSDHC support for up to 8GB. It will have the capacity to store music files to the max. 
The LG Chocolate 3 runs on 800/1900 MHz network and is a dual band CDMA phone. When it is released it will sell for $129 and have a $50 rebate. That price is with a 2-year contract agreement. If you want to purchase it outright, it is set to sell for $299.
The buzz on the street was that it was to be released July 11, 2008. That date has been moved up to the 14th.  Having missed those dates it is safe to say that it will be hitting the streets any day now.

The Consumer Electronics Show in Las Vegas

Have you noticed there has been a lot of gadget and technology related news lately concerning iPods,iPhones and MP3 players in general? I have certainly noticed this trend, it is as if the Apple Corporation and other such firms are on some sort of offensive. here is more on this particular topic:

   Case Logic made an appearance at the Consumer Electronics Show in Las Vegas and introduced their new line of cases and protective covers for iPods and other personal players.

  In the new line of iPod cases from Case Logic, there are cases made of neoprene and slip cases that are made of silicone, along with several others that while protective for the iPod also have piazzas. Ones like the new line of universal pockets, these protective covers are styled to appear like miniature sleeping bags that will protect from scratches and marring. Case Logic has also produced a line for the iPod owner who needs a hard styled case, there are two in this line that were brought out at the electronics show. The hard cases are a tin with a neoprene inside for protecting the iPod and come with either a slider or what is termed a folio.

   The slider is the, a tin protective cover with a slide feature that the tin slides off the face of the iPod. The second is named a folio, this is one in which the tin rather than slides folds open, like a hinged tin box and for extra protection has a silicone interior.  In

It is a pretty cool gadget as it is fully capable of handling MP3, WMA, and WAV audio files, plus AVI and MPEG-4 video. How is that for an environmentally friendly toy?

Apple expanding iPod Line

It seems that Apple may be considering taking the Apple iPod line to the next level for iPod owners.

   There have been rumbling on the Internet about Apple iPod owners being able to have digital downloads of movies available to them.

  This appears to be in discussion between Apple and movie studios, to make digital copies of movies that will be compatible with the Apple iPods to download. A deal like this could make using an iPod a whole new experience for the iPod owner.

   This of course will just as music, will be a feature of iTunes and will also be found at iTunes for downloads or as a feature on DVD’s when placed in a computer there will be a place on theDVD menu that will tell the viewer what version of iTunes needs to be loaded in order to watch the iPod version of the movie and a serial number that will need to be used to access the digital download at iTunes.

   Having a feature like this will change the use of iPods for some owners who will be able to view the latest movies that are available to download, along with listening to music of all genres.  Meanwhile, in

related news, the overall numbers are in from this past November in the radio industry and they are down from November of 2006 by six percent.

 Among the reasons listed that are taking listeners away from radio is the iPod that can now be found in cars that have docking stations built in, along with other reasons such as availability to radio on the Internet and satellite radio.

   Analysts expect that the percentage rate will decline approximately five percent more over this year, as there is an increase in personal digital music players. This is placing the position of radio operators and commentators in a fragile position.

The Belkin RockStar

A new product by Belkin will be making its appearance in the United States in March and in the international community in April of this year and has been named RockStar, which will become a popular iPod accessory in the near future. The RockStar might not be for everyone, it will however be for many iPod users who want to not only enjoy their listening experience but want to share it or join in with someone else’s tunes. This new accessory will make it possible to include up to five other people to listen to their iPod music and the RockStar accessory also has the capability to join multiple iPods together.

   This new RockStar has a hard wired connection that attaches the iPod or MP3 player and has ports to connect five other headphones or players together, it also has controls to mix and for fade-ins for each of iPod or MP3 players. The RockStar will be packaged with one connection cord and to attach other listeners either headphones or cables will be needed to connect the other four listeners or players together for the RockStar experience. Belkin has produced the RockStar with teens and tweens in mind to be able to share their music preferences with other iPod and MP3 owners as well as non-owners.
